The Child Support (Assessment) Act 1989 (the Assessment Act) provides that when CSA accepts an application for an administrative assessment of child support, it must calculate the amount payable using the formulae in Part 5 of the Assessment Act. In some cases, this formula assessment may be varied by an administrative departure (Change of Assessment), a court order for a departure, or an agreement between the parents.
There are legislative changes to the formula from 1 July 2008. The new formula will be based on the cost of children, the income of both parents, the care of children for whom child support is payable, whether the parents have any relevant dependent children living with them and whether the parents have any children in other child support cases.
